Your privacy matters to us. This Privacy Policy explains how Fulcrum Pte Limited collects, uses, stores, and shares your personal information when you use the Fiji Jobs platform. Please read this policy carefully before using our services.
1. Data Controller

Fulcrum Pte Limited ("we", "us", "our", "the Company") is the data controller responsible for your personal information collected through the Fiji Jobs platform ("Platform"), accessible at jobs.com.fj and any associated subdomains.

2. Information We Collect

We collect personal information directly from you, automatically through your use of the Platform, and from third-party services. The categories of information we collect depend on whether you are a Job Seeker, Employer, or visitor.

2.1 Information You Provide Directly

All Users:

  • Full name
  • Email address
  • Password (stored in encrypted/hashed form ; we never store plaintext passwords)
  • Phone number
  • Any information submitted through our contact form

Job Seekers additionally provide:

  • Date of birth
  • Gender (optional)
  • Location / province within Fiji
  • Current employment status
  • Job category and location preferences (for job alert matching)
  • Work experience history (job titles, employers, dates, descriptions)
  • Education history (qualifications, institutions, graduation years)
  • Skills and certifications
  • Professional headline and biography
  • Resume / CV file (PDF, DOC, DOCX formats)
  • Profile photograph
  • Social or professional profile links (e.g. LinkedIn (optional))
  • Cover letters and application messages submitted to employers

Employers additionally provide:

  • Company / organisation name
  • Industry sector
  • Company description
  • Company logo
  • Company website URL
  • Physical business address
  • Account type selection (Free or Premium)
  • Payment references (e.g., MPaisa transaction IDs, bank transfer references); we do not store full card numbers or bank account details
  • Job Listing content (job titles, descriptions, requirements, salary ranges, locations, deadlines)
2.2 Information Collected Automatically
  • IP address and approximate geographic location derived from IP
  • Browser type and version
  • Operating system
  • Pages visited on the Platform and time spent
  • Referring website or source
  • Job Listings viewed (to track view counts and prevent duplicate counting)
  • Session data stored in server-side PHP sessions
  • Session cookies (see Section 9, Cookies)
2.3 Information from Third Parties

We may receive limited information from third-party payment processors (such as PayPal) confirming whether a payment was completed. We do not receive full financial details beyond what is needed to confirm and record payment status.

3. How We Use Your Information

We use the personal information we collect for the following purposes:

  • Account creation and authentication: To register, verify, and manage your account on the Platform.
  • Account review and approval: To assess new account registrations as part of our mandatory approval process.
  • Service delivery: To operate and provide the core features of the Platform, including job posting, job searching, application submission and management.
  • Job matching and alerts: To match Job Seekers with relevant Job Listings based on their category and location preferences and to send them notifications and email alerts for matching vacancies.
  • Employer features: To display candidate match counts, manage credits and subscriptions, and facilitate access to Job Seeker profiles for recruitment purposes.
  • Payment processing and verification: To record, verify, and activate purchases of post credits and Premium subscriptions.
  • Communications: To send you service-related notifications, account status updates, and responses to your enquiries.
  • Platform improvement: To analyse usage patterns, diagnose technical issues, and improve the performance and features of the Platform.
  • Legal compliance: To comply with applicable laws and regulations, resolve disputes, and enforce our Terms and Conditions.
  • Security: To detect, prevent, and investigate fraudulent activity, abuse, and unauthorised access.
  • Social media distribution: To publish Job Listings on our Facebook Page and Viber channel as described in Section 6.
4. Legal Basis for Processing

We process your personal information on the following legal bases:

  • Contractual necessity: Processing required to provide you with the services you have signed up for, including account management, job posting, and applications.
  • Legitimate interests: Processing necessary for our legitimate business interests, such as platform security, fraud prevention, and service improvement, where these interests are not overridden by your rights.
  • Consent: Where you have explicitly provided consent, such as for optional job alert notifications and for your profile being made searchable by Employers. You may withdraw consent at any time through your account settings.
  • Legal obligation: Processing necessary to comply with applicable laws and regulations in Fiji.
5. Disclosure of Your Information

We do not sell your personal information to third parties. We share your information only in the following circumstances:

5.1 With Other Platform Users
  • Job Seeker profiles (name, headline, location, skills, experience, education, and uploaded resume) are made visible to approved Employer accounts for recruitment purposes. Job Seekers can control profile visibility from their account settings.
  • Job applications submitted by Job Seekers are shared with the relevant Employer who posted the listing.
  • Employer profiles (company name, description, logo, website) are publicly visible alongside their Job Listings.
5.2 With Third-Party Service Providers

We share limited information with trusted third-party services that help us operate the Platform:

  • Meta Platforms (Facebook): When a Job Listing is posted, the listing content (job title, company name, description excerpt, and link) may be published to our official Facebook Page via the Facebook Graph API. By posting a Job Listing, Employers consent to this. Meta processes this data in accordance with Meta's Privacy Policy.
  • Viber Communications: Job Listing content may be broadcast to subscribers of our Viber channel. Job Seekers who subscribe to our Viber channel consent to receiving these broadcasts. Viber processes this data in accordance with Viber's Privacy Policy.
  • PayPal: When you choose to pay via PayPal, you are redirected to or interact with PayPal's interface. PayPal processes your payment data in accordance with PayPal's Privacy Policy. We receive only a confirmation of payment status and transaction reference.
  • Web hosting / server infrastructure: Our Platform is hosted on servers. Our hosting provider may have access to server-level logs and data as part of providing infrastructure services.
5.3 Legal Disclosures

We may disclose your personal information if required to do so by law, court order, or government authority, or if we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

5.4 Business Transfers

In the event of a merger, acquisition, or sale of all or part of our business, your personal information may be transferred to the acquiring entity. We will notify you via email and/or a prominent notice on the Platform prior to your information being transferred and becoming subject to a different privacy policy.

6. Social Media and Third-Party Platforms

6.1 By posting a Job Listing on the Platform, Employers grant Fulcrum Pte Limited permission to distribute that listing on our social media channels, including our Facebook Page and Viber channel. This distribution is automatic upon listing approval.

6.2 Once content is published to Facebook or Viber, it may be publicly visible, shared by users of those platforms, and cached or indexed by those platforms or search engines. We cannot guarantee the removal of content from third-party platforms after it has been published.

6.3 If you interact with our Facebook Page or Viber channel directly, Facebook and Viber collect and process your data in accordance with their respective privacy policies. Fulcrum Pte Limited is not responsible for those third parties' data practices.

6.4 Our website may contain links to third-party websites. This Privacy Policy does not apply to those sites and we are not responsible for their privacy practices.

7. Data Retention

We retain your personal information for as long as your account is active and for a reasonable period thereafter, as follows:

  • Active accounts: We retain all account data for the duration of your account's existence on the Platform.
  • After account closure: We retain your data for up to 3 years after account closure for legitimate business purposes (e.g., dispute resolution, legal compliance, fraud prevention) unless a shorter retention period is required by law.
  • Job Listings: Closed or expired Job Listings and associated applications are retained for up to 2 years for record-keeping purposes.
  • Payment records: Financial transaction records are retained for up to 7 years in accordance with Fiji taxation and financial record-keeping requirements.
  • Contact form submissions: Enquiries submitted via the contact form are retained for up to 2 years.
  • Server logs: Technical server access logs are retained for up to 90 days.

After the applicable retention period, we will delete or anonymise your personal information in a secure manner.

8. Your Rights

Subject to applicable Fijian law, you have the following rights in relation to your personal information:

  • Right of Access: You have the right to request a copy of the personal information we hold about you.
  • Right to Rectification: You have the right to request that we correct any inaccurate or incomplete personal information.
  • Right to Erasure: You have the right to request deletion of your personal information, subject to our legal and contractual obligations and legitimate retention requirements.
  • Right to Restrict Processing: You have the right to request that we restrict the processing of your information in certain circumstances.
  • Right to Data Portability: You may request that we provide your personal data in a machine-readable format where technically feasible.
  • Right to Withdraw Consent: Where processing is based on your consent, you may withdraw it at any time. Withdrawal does not affect the lawfulness of processing before withdrawal.
  • Right to Object: You may object to processing based on our legitimate interests where you believe your rights override those interests.

To exercise any of these rights, please contact us at hello@jobs.com.fj. We will respond to your request within 30 days. We may require verification of your identity before processing your request.

Please note that certain rights may be limited where we have overriding legal obligations or legitimate interests, or where fulfilling the request would adversely affect the rights of other individuals.

9. Cookies and Tracking Technologies

9.1 Session Cookies: The Platform uses PHP session cookies to maintain your login state and session information. These cookies are temporary and are deleted when you close your browser. They are strictly necessary for the Platform to function and cannot be disabled.

9.2 No Third-Party Tracking Cookies: We do not currently use third-party tracking or advertising cookies on our Platform. We do not use Google Analytics, Facebook Pixel, or similar third-party tracking scripts on the core Platform.

9.3 Flash Message Cookies: We use short-lived session variables to display one-time notification messages (e.g., "Login successful"). These are not persistent cookies.

9.4 Social Media Embeds: If we embed content from Facebook, Viber, or other third-party platforms on any page, those platforms may set their own cookies in accordance with their privacy policies.

9.5 By continuing to use the Platform, you consent to the use of strictly necessary session cookies as described above.

10. Data Security

We implement appropriate technical and organisational security measures to protect your personal information against unauthorised access, loss, destruction, or alteration. These measures include:

  • Password hashing using bcrypt with strong cost factors; plaintext passwords are never stored
  • Prepared statements and parameterised queries to prevent SQL injection
  • Cross-Site Request Forgery (CSRF) token validation on all forms
  • Output escaping to prevent Cross-Site Scripting (XSS)
  • HTTPS encryption for data in transit (where SSL is configured on the server)
  • File upload restrictions (type validation, size limits, secure storage locations)
  • Role-based access controls limiting data access to authorised users only
  • Session security measures to prevent session hijacking

While we take these measures seriously, no method of transmission or storage over the internet is 100% secure. We cannot guarantee absolute security and you transmit data to us at your own risk. In the event of a data breach that affects your rights and freedoms, we will notify affected users as soon as reasonably practicable.

11. Children's Privacy

The Platform is not directed at children under the age of 18. We do not knowingly collect personal information from individuals under 18. Account registration requires users to confirm they are at least 18 years of age. If we become aware that we have inadvertently collected information from a person under 18, we will delete that information promptly. 12. International Data Transfers

Your personal information is primarily stored and processed in Fiji. However, by using third-party services such as Facebook, Viber, and PayPal, your information may be transferred to and processed in countries outside Fiji, including countries that may have different data protection standards. Where such transfers occur, they are governed by the privacy policies of those respective third parties, as referenced in Section 5.2. We rely on those providers' standard contractual and policy protections for such transfers.

13. Job Seeker Profile Visibility

13.1 By default, your Job Seeker profile (including your name, headline, location, skills, work history, and education) is searchable and visible to approved Employer accounts on the Platform. This is a core function of the service.

13.2 Your resume file is accessible to Employers when they review your job applications. Your resume is not publicly listed without an application.

13.3 You may manage your profile visibility, alert preferences, and data settings from your account dashboard at any time.

13.4 If you delete your account, your profile will no longer be visible to Employers. Subject to our retention policy in Section 7, your data will be permanently deleted.

14. Communications

14.1 Service Notifications: We will send you notifications relating to your account and use of the Platform (e.g., application received, account approved, payment confirmed). These are necessary communications and cannot be opted out of while your account is active.

14.2 Job Alert Emails: If you have selected job alert preferences, we will send you email notifications for matching Job Listings. You may update or remove these preferences from your dashboard at any time.

14.3 Marketing Communications: We do not currently send promotional or marketing emails beyond job alerts. If we introduce a newsletter or marketing communication in the future, it will be opt-in only.

15. Changes to This Privacy Policy

We reserve the right to update this Privacy Policy at any time to reflect changes in our practices, legal obligations, or the services we offer. When we make material changes, we will update the "Last updated" date at the top of this policy and may notify you by email or by posting a prominent notice on the Platform. Your continued use of the Platform after any changes constitutes your acceptance of the revised Privacy Policy. We encourage you to review this policy periodically.

16. Complaints

If you believe we have not handled your personal information in accordance with this Privacy Policy or applicable law, you have the right to lodge a complaint. We encourage you to contact us first at hello@jobs.com.fj so that we can attempt to resolve the matter. You may also have the right to complain to a relevant supervisory authority in Fiji.
